Minutes of April 1 and April 15, 2015 approved.

Perc Test Season:  In light of standing high water at Beetlebung Corner, the Board decided to extend the perc season until its next meeting, May 20th.

Lurie, Gosnold’s Way (14-1.2A) Chris Alley presented a well permit application which does not require variances.  The Board approved the permit application, stipulating that the existing well point must be decommissioned when the new well is established.

Lurie, Gosnold’s Way (14-1.2A) Chris Alley presented a 2-bedroom septic system construction permit application with four-bedroom capacity to serve an existing two bedroom dwelling which will be renovated.  The plan does not require variances and was approved by the Board.

Tea Lane Caterer  Following up on the letter sent to Tea Lane Caterer regarding the need for a review of the ware-washing arrangements, the Board decided to hold the review at its next meeting, on May 20th, and asked Marina Lent to contact owner Dee Smith to inform her.

Scott, 16 Shepherd’s Path (24-1) Reid Silva presented a septic plan revision for a second house on a 29 acre property.  The permit was approved for a guest house with a pump system in 2009, which remains valid under the permit extension act.  The plan has been revised to relocate the leaching field and show the new proposed house.  The Board approved the permit, on condition that the installer must consult with the design engineer prior to installation, and the existing septic system must be properly abandoned in accordance with Title 5, with the abandonment referenced in the as-built letter.

Botwick, 29 Fulling Mill Brook Road (25-57) Title 5 Official Inspection Report – fails  Reid Silva asked the Board for a public hearing on an upgrade plan that will require variances.  The hearing will be held at the Board’s first meeting in June 2015 at 5:30pm.

Pratt, 128 Old Farm Road (3-35) Chris Alley  presented a septic system construction permit for the installation of composting toilets, thus restoring the septic system to compliance.  The composting toilets had been removed some months ago without regard to septic capacity. The Board noted that an Operation and Maintenance contract has been drawn up with Clivus NE, and asked Marina Lent to contact Clivus to include in the contract that the liquid levels in the leaching pit should be routinely checked as per the original approval of the system plan by the Board of Health in 2001.  The Board approved the installation application.

Rabies exemption The Board considered a rabies vaccine exemption request for “LeoPold” (Stephanie DaRosa, 11 Shadbush Hollow).  LeoPold is immune-compromised.  The Board approved the request.

Larsen, 2 Menemsha Crossroad (26-100) Kent Healy discussed a plan for a replacement well at the property.  The Board suggested that it would be prudent to assess the best location for a septic system upgrade prior to drilling a new well, as the property is quite challenging because of wetlands and high groundwater.  

Artery Capital LLC, 18 Peaked Hill Road (25-13) The Board reviewed a septic system revision plan prepared by George Sourati.  The Board approved the revision, contingent on confirmation that the only change to the plan was to move the system 8’.

Lindauer/Finbury, 2 Marsh Road (27.1-26) The Board noted non-compliance with BOH Regulation requirements for maintenance of FAST system on this property, and also apparent lack of follow-through on the Board’s requirement to bury the electric lines servicing the FAST system.  The Board will send a registered letter to the owners, informing them that “you will need to have an Operation and Maintenance Agreement in place and have the system serviced as per requirements outlined in the (enclosed) letter dated December 20, 2006 prior to use of your septic system in the 2015 season.”

Jason, 6 Arno Camp Road (24-180) Kent Healy presented a replacement well permit application for a new well to be drilled in the immediate vicinity of the existing well, which is experiencing difficulty.  The proposed location will require a variance for its separation to the property line – the abutting property in question is under the same ownership.  The Board noted that for a replacement well which does not require significant new variances, a public hearing will not be required, and approved the application.

Taylor, (33-26,27,28)  Reid Silva discussed with the Board how to proceed with a system upgrade for a drip dispersal system which had been permitted on March 4, 2009.  In light of the difficulty of successfully operating a drip dispersal system for a seasonal residence that is occasionally used in winter, the owner would prefer to install a FAST system instead.  The Board confirmed that vertical separation to groundwater can be achieved at the site, and noted that it may be advisable to install a noise reduction device.

Squibnocket District use of herbicides/pesticides:  Following a request from landscaper Josh Scott for a BOH determination on what constitutes “chemical fertilizers, herbicides, fungicides, pesticides, … and other such substances” in Squibnocket (Chilmark Zoning Bylaw, Section 12.6.H), the Board decided to review this question at its May 20th meeting, and asked Marina Lent to invite Josh Scott to prepare a list of organic herbicides and pesticides proposed for use in Squibnocket.

Malkin, 10 Tilton Cove Way (25-124) Jim and Joan Malkin came to the Board to discuss requirements for building an accessory apartment on their property.  A septic system for the proposed 400ft2 detached accessory apartment would require variances, especially in light of the fact that it will be located within the coastal district.  The Malkins indicated that their preference would be to build a separate system for the unit, rather than tying into their existing system.

The Board noted that an “accessory apartment” under the newly-approved Chilmark Zoning Bylaw would not fall under the same septic requirements as a guest house, which in Chilmark requires demonstrating the ability to construct two separate, fully-compliant septic systems.  The Board suggested that soil tests be undertaken to evaluate the feasibility of the proposal.

Homeport/Menemsha Inn/Beach Plum Inn:  The Board of Health met with Josh Aronie and new Beach Plum Inn chef Nathan Gould to discuss the terms of a catering permit to serve Inn- and Homeport-related events.  At issue is to enable the kitchens of the Homeport Restaurant and Beach Plum Inn to service off-site catered events connected to the Menemsha and Beach Plum Inns.  Management will have to ensure that pressures of servicing events do not conflict with safe operation of the existing restaurants, and will establish criteria of staffing, timing, food transport and patron-number limitations to ensure that this is the case.  The Board discussed its concerns and asked Josh Aronie and Nate Gould to come to the next meeting of the Board on May 20th with a detailed plan, based on HACCP analysis, for review.  The Board will entertain caterers permits for the Beach Plum Inn and for the Homeport Restaurant on that basis.

Chilmark Store, 7 State Road (30-84)  Clivus NE Inspection report –peak daily flow of 350 gpd.
